a gap between my tub and the stud

(part 3)

Ok so my problem is that I have a gap between my tub and the stud. I don't want to remove this 2x4 as it would cause more damage to wall on other side. I can leave this 2x4 where it is and it will not get in the way, but I don't want to leave this gap so I got a 2x3 and notched out one corner. The reason I notched out one corner is because the tub is resting on a 2x4 ledge and I would like the 2x3 to go down a bit more then this ledge.  Now I want to screw this 2x3 into the 2x4 and have it plum with the other studs.

   

   

 

Now when I add my cement board it is flush with the tub and has no bends in it.
